The Sixth Judicial District Court has granted the motion to dismiss filed by Rick Koehmstedt on behalf of a homeowner being sued for injuries suffered on his property. The plaintiff alleged that he was blinded in an altercation on the property, and argued that the homeowner was responsible for the injuries under the circumstances. The District Court agreed with Koehmstedt’s arguments and dismissed the claims against the homeowner as a matter of law.
